FAQ

7 States Where Online Gambling Is Legal in the US (2026 Update)

As of 2026, online casino gambling is legal in exactly 6 states across the United States: New Jersey, Delaware, Pennsylvania, West Virginia, Michigan, and Connecticut. These states let players gamble on real-money online slots, table games like blackjack and roulette, and live dealer games through licensed websites and mobile apps. If you live in any of the other 44 states, you cannot legally play online casino games from home unless you visit one of these six states.

Are Online Casinos Legal in the US? 2026 Complete Guide

Are online casinos legal in the US? The quick answer is no, not for the whole country. Online casinos are only legal in seven specific states as of 2026. These states are New Jersey, Delaware, Pennsylvania, West Virginia, Michigan, Connecticut, and Rhode Island. If you live in any other state, you cannot legally play real-money online casino games right now. You also need to be physically inside one of these seven states to play, even if you are a resident of a legal state.

2026 New Gambling Tax Law: 90% Loss Rule Explained

Gambling rules for 2026 change in a big way for taxes: under the One Big Beautiful Bill Act, the IRS limits gambling loss deductions to 90% of your winnings, starting for taxable years beginning after December 31, 2025. This matters because many people assume they can fully cancel taxes by subtracting losses, but in 2026 you can end up paying taxes even when you don’t “net” profit. Example 1 (break-even): If you win $100,000 and lose $100,000 at the casino or through betting, the taxable result changes from $0 in prior years to $10,000 in 2026 because only 90% of your losses can offset winnings.
