Where Is Online Betting Legal? 2026 State Guide
What States Are Legal to Bet Online?
As of October 7, 2026, 31 states and Washington, D.C., offer broadly available online sports betting through regulated operators. Online casino games are available in seven states; Maine has legalized them, but its market has not launched.
The rules depend on what you want to bet on. A state may allow sports betting apps but prohibit online casino games, and some states limit mobile betting to specific locations. You must be physically within an authorized area and use an operator approved for that market.
States With Online Sports Betting
The following 31 states offer broadly available online or mobile sports betting:
Arizona, Arkansas, Colorado, Connecticut, Delaware, Florida, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Missouri, Nevada, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Rhode Island, Tennessee, Vermont, Virginia, West Virginia, and Wyoming.
Washington, D.C., also has regulated online sports betting, but it is not a state.
Some markets have extra restrictions. In Louisiana, online wagering is available only in parishes that authorized it. In Nevada, you must register for a sportsbook account in person before placing mobile bets.
Missouri joined the legal sports betting market in December 2025, so older guides may not include it.
States With Online Casinos
Seven states have live, regulated online casino markets: Connecticut, Delaware, Michigan, New Jersey, Pennsylvania, Rhode Island, and West Virginia. Maine has also legalized online casinos, but operators have not launched there yet.
Maine legalized online casinos in January 2026. As of October 5, 2026, its rules and licensing process were still being finalized, and no confirmed launch date had been announced.
Online sports betting does not automatically make online casino games legal. For example, Virginia allows regulated online sports betting but is not among the states with a live, regulated online casino market.
Online poker is another separate category. Check your state’s rules and approved operators before playing, because permission for sports betting or casino games does not necessarily include online poker.
States With Limited or No Broad Online Sports Betting
Some states allow sports betting only at retail locations, tribal venues, or other approved sites. Montana, for example, allows mobile wagers through Sports Bet Montana only at approved locations, rather than from anywhere in the state.
The following eight states have some legal sports betting but do not offer the same broad online access as the states listed above: Mississippi, Montana, Nebraska, New Mexico, North Dakota, South Dakota, Washington, and Wisconsin.
As of October 2026, these 11 states do not have a live, state-regulated sports betting market: Alabama, Alaska, California, Georgia, Hawaii, Idaho, Minnesota, Oklahoma, South Carolina, Texas, and Utah.
These lists refer to sports betting, not every form of gambling. Lottery games, horse-racing wagers, fantasy contests, and other products may follow different laws.
What to Check Before You Bet Online
First, confirm that online betting is legal where you are physically located. A betting account opened in one state does not allow you to place wagers from another state where that activity is not authorized. Some markets also have local restrictions, such as Louisiana’s parish-by-parish rules.
Next, use an operator approved for the specific product you want. A sportsbook’s availability does not prove that its casino or poker games are legal in your state; check the state regulator’s approved operator list and game rules.
Finally, check registration and eligibility requirements. Nevada requires in-person sportsbook registration, and age rules can vary by state and type of gambling.

Who Runs Online Gambling in the USA? State Secrets Revealed
Online gambling in the USA is mainly regulated by state governments, not by one national agency. Each state sets its own rules, so the legal status can change a lot from one place to another. For example, New Jersey allows regulated online casinos and sports betting, while some states allow only sports betting or ban online gambling altogether. State gaming commissions or similar agencies usually handle the day-to-day oversight. They issue licenses, check operators for fairness and security, and enforce the rules.
